To make your buying experience with us as smooth and risk free as possible, we have put together the terms and conditions of sale in this section.

Our agreement with you:

1.Putting our arrangement in place.

1.1.In this agreement, we are OCD Climbing of 2 Jemisons Yard, Westgate, Pickering, North Yorkshire. YO18 8BA and you are the person placing the order by email, phone or postal correspondence.

1.2.Our agreement is made on the date we deduct payment from your account, the details of which you provided with the order.

1.3.Our agreement includes all correspondence from us to you and the descriptions of the Goods as provided by us on our Website or otherwise.

2.Making your choice and ordering.

2.1.Peruse our website, call or email for advice and select your chosen product.

2.2.Contact us, via email or standard post. For monogrammed or bespoke articles include a complete description of Goods required including correct spelling of any names etc. Alternatively for standard products you can phone and order.

2.3a It is the customer's responsibility to ensure that all text and images supplied are not in any way copyright protected and are free to be reproduced without infringement.

2.3b We reserve the right to refuse any design we believe to be unsuitable for production without giving reason.

2.4 With bespoke bags we will then contact you to confirm the pricing and the design.

2.5. .Please ensure the delivery address given by you is correct as mistakes cannot be rectified after goods have been shipped. If your goods do not arrive in a reasonable period of time (UK- 10 working days, Worldwide- 20 working days) please don't hesitate to contact us, we are very happy help.

2.6. For shipments beyond the UK mainland and Northern Ireland please contact us for delivery costs.

2.7. The children’s chalk bags we sell are not toys. They have small parts that could be swallowed. We recommend not leaving children unattended with our products.

2.8. We will no longer manufacture custom chalkbags ordered by private individuals with charity's logos or designs, even with consent of the charity. We are are a small business and can only afford to support one charity (the Wilf Ward Family Trust) and this is often a struggle. All monies made on the sales of custom charity bags is given to the charities named on those bags.

2.9. We never include mock-up designs of custom chalk bags due to the amount of time this adds to the production process. The customer can pay for mock-up costs @£10 per design, this is in addition to any given quotes.

3.What happens next with standard Goods?

3.1.After payment has been received, if your chosen products are in stock (and in accordance with 3.2) your Order will be processed and Goods despatched to the given delivery address.

3.2.As a competition rock climber for Great Britain, occasionally I will be out of the country or otherwise unable to ship stock immediately. In this case a warning will be issued whenever possible and Goods shipped as soon as possible.

3.3.All standard Goods will be despatched with proof of purchase emailed through separately (if you have not received this proof of purchase, check your junk box and then contact us for a re-issue).

3.4.If for any reason the products you have ordered are not in stock, you will be advised of this and informed of when delivery can take place. If this is not satisfactory you have the option of cancelling your order.

3.5.Should you not receive your Goods within 10 days of payment being taken, please contact us to let us know. (Non UK mainland orders please allow 20 days). You will then be given the choice of:

3.5.1.Cancelling your Order whereupon we will refund the price you paid or

3.5.2.Waiting a further agreed time period after which if your chosen products have not been received then option

3.5.1 will be available to you.

3.6.Should you choose option 3.2.1 then your refund will be made in the same manner as payment e.g. PayPal to PayPal, cheque to cheque etc.

3.7. If you make payment by an OCD gift voucher,

3.7.1. Please be aware of the expiration date on the voucher as any vouchers presented after this date will not be accepted.

3.7.2. Vouchers are non-refundable (unless product is deemed faulty)

3.7.3. Vouchers are not to be copied or sold by anyone other than OCD climbing, any vouchers deemed to be copies or to have been sold will not be accepted and will invalidate the original with no refund.

3.7.4. Should the full value of the voucher not be used the remaining value will be re-issued as a gift voucher, no cash will be returned for the remaining value. Should the purchase exceed the value of the voucher the remaining cost will need to be settled prior to shipping of the Goods.

3.8. Please be aware that in rare occasions fabrics and thread used in your product may not be exactly the same as shown in the images on the website or email. They will be as close as possible, both colour and design wise.

3.9 Please be aware that in rare occasions embroidery used on your product may not be exactly the same as shown in the images on the website or email.

4.What happens next with bespoke Goods?

4.1.After payment has been received the manufacturing of your Goods will commence. These can take several days to complete during busy periods. When completed they will be despatched to the given delivery address.

4.2.All bespoke Goods will be despatched with proof of purchase.

4.3.Should you not receive your Goods within 10 days of payment being taken, please contact us to let us know. (Non UK mainland orders please allow 20 days).

5.If you are not satisfied with standard Goods.

5.1.All Goods returned must be accompanied with proof of purchase.

5.2.You may return the products to us whereupon a full refund will be made as described in 3.2 above provided that the products are returned in the same conditions and original packaging (e.g. labels still attached etc.) as received, within 14 days of your receipt of the goods.

5.3.If the Goods are not faulty the customer will pay for the return delivery costs.

5.4.If the Goods are faulty the customers will pay for the return delivery costs.

5.5.You may request replacement products, which we will despatch to you (subject to availability) on receipt of the original products, which were not satisfactory from you. If there is a price difference between the orders, the original products will be refunded and a new order placed.

5.6.The quantity and description of your chosen products shall be those set out in the email or standard postage correspondence. If the order was placed by telephone we reserve the right to withhold refunds in regard to style and spelling, should the telephone ordered Goods be faulty, a refund will still be offered. We would naturally recommend all Orders be placed in writing as this minimises misunderstandings.

5.7.All our products are tested and packaged securely for despatch. However, on rare occasions Goods can become damaged in transit. If you have received faulty Goods we request that you inform us within 14 day of receipt of Goods.

6.If you are not satisfied with bespoke Goods

6.1.As bespoke items are by definition individual, the Goods are non-refundable unless due to fault. If the Goods are not as described in the order confirmation then this will also be grounds for a refund, please check the order confirmation as some designs will need altering for practicality.

6.2.If the Goods are not faulty the customer will pay for the return delivery costs.

6.3.If the Goods are faulty the customers will pay for the return delivery costs.

6.4.You may request replacement products, which we will despatch to you (subject to availability) on receipt of the faulty original products from you. If there is a price difference between the orders, the original products will be refunded and a new order placed.

6.5. Our company logo is of a standard size and will appear on all chalkbags (colour may vary for contrast on some fabrics). We reserve the right to change our logo design without informing the customer.

7.Basis of sale.

7.1.The terms of this, Our Agreement with You, shall govern our contract to the exclusion of any other terms and conditions.

7.2.Any typographical, clerical or other error or omission in any sales literature, price list, acceptance of offer or other document or information issued by us is subject to amendment by us where reasonable.

7.3.You are responsible for ensuring the accuracy of your Order and the details provided therein.

7.4.The quantity and description of your chosen Goods shall be those set out in the order confirmation unless we subsequently agree otherwise.

8.Price of the Goods.

8.1.The price of the Goods and delivery shall be the price quoted in the order confirmation. The prices indicated on the Website can change depending on the design and postage costs; these are not necessarily the final cost.

8.2.The price is inclusive of any payable value added tax in the UK. Customers outside the EU will not receive this amount as a discount off the price of the Goods.

9.Risk and property.

9.1.Risk of damage to and loss of your chosen products shall pass to you upon delivery of them.

9.2.Notwithstanding delivery and the passing risk in your chosen products or any other provision of this Agreement, property in your chosen products shall not pass to you until we receive cleared funds payment in full of the price of your chosen products.

10.Warranties.

10.1.Due to the intended usage of the Goods sold by us the warranty offered is 3 months from date of delivery. We warrant that the Goods if not misused be free from defect for this period. Any faults occurring through wear and tear beyond this period are not covered by this warranty.

10.2.The buttons used in some designs and ‘creature goggle eyes’ attached to some products are not covered by the above warranty. They are top quality safety eyes, with secondary glue, but due to design limitations they are not included in the above offered warranty.

10.3.All returned Goods must be accompanied with proof of purchase.

11.Force Majeure

11.1.We shall not be liable to you or deemed to be in breach of this Agreement by reason of any delay in performing or any failure to perform any of our obligations if the delay or failure was due to any cause beyond our reasonable control. Without prejudice to the generality of the foregoing the following shall be regarded as causes beyond our reasonable control;

11.2.Acts of God, explosion, flood, tempest, fire or accident.

11.3.War or threat of war, sabotage, insurrection, civil disturbance or requisition.

11.4.Acts, restrictions, regulations, bye-laws, prohibitions or measures of any kind on the part of any governmental, parliamentary or local authority.

11.5.Import or export regulations or embargoes

11.6.Strikes, lockouts or other industrial actions or trade disputes (whether involving employees of us or of a third party).

11.7.Power failure or breakdown in machinery.

12.Privacy.

12.1.When you place an order with us, we do need some personal information from you in order to process your order. For example E-mail address and delivery address as well as payment details. We will never sell this information to another company. We may contact you from time to time with information regarding offers and company developments. If you would like to be removed from this service please email and request your details removed. Payment details will never be stored beyond the necessary information required by law.

13.General.

13.1.If any provision of this Agreement is held by any competent authority to be invalid or unenforceable in whole or in part, the validity of the other provisions of this Agreement and the remainder of the provision in question shall not be affected hereafter.

13.2.The contract shall be governed by the laws of England.

14.Whole Agreement.

14.1.The terms and conditions set out in this Agreement represents the entire Agreement.

Your statutory rights are not affected by any of the above.

English Law applies
